Are house plans copyrighted?
Yes, all house plans created by Fusion Design are protected under federal copyright laws. This means that no one may reproduce, modify, or reuse our designs without our written consent. Copyright protection applies to all aspects of our plans, including 2D artwork, 3D renderings, floorplans, and technical drawings.
Can I modify a plan without violating copyright?
No. Making changes to or redrawing a copyrighted plan does not remove its copyright protection. The exclusive right to modify a design belongs to the original copyright holder. Additionally, copying or recreating a built home that is protected by copyright—regardless of whether you have seen the original plans—is also a violation. To modify a plan legally, you must purchase it from an authorized source and request modifications through Fusion Design.
Can I build the same plan more than once?
By default, our plans are sold with a single-use license, which allows you to build the home one time only. If you wish to build the same design multiple times, you must purchase an unlimited build license, which grants permission to build the plan as many times as needed.
Can I make copies or print from the PDF?
All of our plans include a reproducible PDF version, which may be printed as needed for construction purposes. However, the license only grants permission to build according to the terms of your single-use or unlimited build license.
Are modified Fusion Design plans still copyrighted?
Yes. Even if you modify a Fusion Design plan using CAD files, the original copyright remains intact. Any modified version of the plan cannot be resold or reused without our written permission. Additionally, making modifications relieves Fusion Design of any liability and voids all warranties, expressed or implied.
Who is responsible for copyright infringement?
Any individual or business involved in a copyright violation may be held liable, including homeowners, builders, contractors, architects, engineers, designers, copy shops, and developers. Lack of knowledge about copyright law is not a valid defense, so all parties should ensure they have proper authorization before using any design.
What are the penalties for copyright infringement?
Violating copyright law can result in severe penalties, including payment of actual damages, forfeiture of profits made from unauthorized use, statutory damages of up to $150,000 per infringement, and legal fees that often exceed damages.
